Vmaker AI Acceptable Use Policy

Users agree to abide by the Acceptable Use Policy as part of their use of Vmaker AI Services. Users acknowledge that failure to follow these guidelines may lead to denial of access and termination of their account and agree to adhere to applicable laws and government regulations, such as those governing intellectual property, data protection, privacy, artificial intelligence, and export control.

Vmaker AI reserves the right to change these terms and conditions and hence users are requested to check for any changes periodically.

Users agree that they shall not use Vmaker AI Services to generate the following types of content:

  • Adult entertainment content;
  • Hateful or extremely insulting material;
  • Gore or graphic violence;
  • Threats, exaltation, or encouragement of violence;
  • Illegal products or activities;
  • Self-injury or encouraging self-harm;
  • Inappropriate representation of minors or in a way that might cause harm or exposing them to inappropriate content;
  • Violent acts or terrorism;
  • Distribution of false information, dishonest, or deceitful material;
  • Unauthorized advertising and promotions ;
  • Engaging in spamming, phishing or disruption of services of one’s own or others or for spreading of malware and virus, and
  • Removal of any distinguishing feature such as watermarks that differentiate between AI-generated and human generated content.

Creating content that violates the copyright, trademark, privacy or other rights of any third party is strictly prohibited. This includes creation and usage of third party's brand logo, uploading content copyrighted by third parties or using a third party's personal information in violation of their privacy or data protection rights.

Accounts that indulge in harmful or deceptive activities, such as using automated processing, impersonation, false, misleading, or inaccurate information, or schemes to increase account engagement, may be disabled.

Users agree to monitor their accounts at all times to prevent misuse and ensure no individual rights are violated.

Vmaker AI does not ask or process any sensitive data(as defined by various privacy regulations). Users are requested not to enter any sensitive information such as passwords, financial or payment information, protected health information subject to the Health Insurance Portability and Accountability Act (HIPAA) or any tax data to the services.

Avatars are digitally created human representations that form a part of Vmaker AI asset library (Stock Avatars). We may also create Avatars specifically for certain Users (Custom Avatars).

Users note that Avatars are not entirely AI generated. Avatars are created from real actors after obtaining their consent. Users agree to moderate the usage of Avatars, including voice and likenesses, to make sure that the rights and interests of individuals are being respected and to prevent any harm.

Vmaker AI Avatars may not be used for generation or usage of AI/ML models. The direct or indirect use of any content, data, output, or other information to create, train, test, or improve any machine learning algorithms or artificial intelligence systems is prohibited.

Stock Avatars may not be used in, or to generate the following types of content(unless a written consent is obtained from Vmaker AI):

  • In TV productions;
  • In or as part of any “paid”, “boosted” or “promoted” content on social media;
  • In the creation or as or part of non-fungible tokens (NFTs) or similar offerings;
  • Portrayal of Stock Avatar in a manner that a person would reasonably find as offensive, such as but not limited to showcase of Stock Avatar as suffering from a medical condition, medicating or indulging in any addiction;
  • For promotion and advertisement of age restricted goods, services or venues, including alcohol, tobacco, vaping products, psychoactive substances, firearms, gambling, sex toys, escort services and dating services;
  • In making statements of opinion, including expression of personal preferences as if such statements were made as Stock Avatar’s own expressions or preferences;
  • To generate content in which the Stock Avatar is making any kind of statement of fact or opinion regarding religion, politics, race, gender, sexuality, or other similar topics that are known to be sensitive to certain demographics; and
  • creating trademarks, design-marks, service-marks, or other similar protected or registrable rights.
